Our Goal:

The goal of 10pays.com is to take advantage of the Internet technology to enable businesses to interact with consumers in highly personalized ways, without forfeiting the privacy of the consumer. Therefore, privacy is at the core of 10pays.com

 

Overview:

Although nearly all of the revenue that supports 10pays.com, our service providers, the membership community and your compensation checks comes ultimately from advertisers and/or marketing partners, neither 10pays.com nor any of our service providers will provide the advertisers and/or marketing partners with any type of mechanism to reach you or any other specific member directly.

Generally speaking, the advertisers are not even interested in reaching a specific member. Rather what our advertising partners are interested in is the ability to reach a certain group of people that share a common demographic characteristic such as gender, age range, interests, or perhaps geographic region with their particular marketing message.

For instance, certain products appeal to and are more often purchased by women than by men. Advertisers promoting these products (such as women’s cosmetics) would prefer to target their messages to just the women in our membership community rather than spending the extra money to reach the entire group of both male and female members. Conversely, since men rarely purchase women’s cosmetics, they have little interest in viewing ads related to these items.

Therefore, in an effort to create a system that works to everyone’s advantage, 10pays.com has created a Privacy Policy that protects the identity and personal information of all of our members while creating group demographics that are presented in summary form to potential advertisers.

Our Promise:

We at 10pays.com are committed to protecting your privacy. We promise to handle all information you provide at 10pays.com including member survey and contact information, as well as any correspondence with complete discretion. We will not release, sell, rent, or otherwise give your name, email address or any other personally identifiable information to any other entity, party or organization except as disclosed in this statement.

Our Policy Summary:

This Privacy Policy provides both members of the 10pays.com service and visitors to the 10pays.com website with information about information we collect, to what uses that information is put, and to whom that information may be given. If you become a member of 10pays.com, the membership agreement encompasses the provisions that are explained by this document. If you are a visitor to our website, this Privacy Policy is our promise to you onhow information about your visit will be handled.

Considering the nascent stage of the Internet’s development, this policy should be considered a “work in progress” and as such is open for comment. Therefore, this policy should be interpreted as an evolutionary framework and will most likely be updated from time to time as circumstances deem prudent. However, the principles upon which this framework are built will not change, nor will our fundamental commitment to protecting the privacy of our members.

10pays.com adheres to the philosophy and principle that the collection of personal information should be limited to that obtained through fair and lawful means and only with the knowledge and consent of the member involved. Therefore, we attempt to make very clear our policies regarding our data gathering processes and seeks consent before obtaining personally identifiable data from any individual.

Information We Collect From Visitors:

For visitors to our website, we gather only aggregate, non-personally identifying data about your visit to our site. If you visit 10pays.com’s website (whether you are using 10pays Banner Bar™ software or not), 10pays.com’s web servers or those of our service providers log a number of basic pieces of information, including the following:

• The URL (address) of the page(s) requested;
• The time and date of the request(s) and the duration of your visit;
• The “User Agent” (the make and model of the web browser being used, including the name and version of the operating system upon which that web browser is running);
• The “Referrer” (the address of the site whose link you followed to get to our website);
• The IP address and domain name of the computer to which we are sending pages for display by your web browser

Information We Collect From Members:

In our online registration form for new members of our service, we require you to provide us with your full name, full mailing address, email address and a password. In addition, we require your gender, birth date and a password question with it’s corresponding answer, so that we may identify you if you ever lose your password.

Certain information such as your name, address, email address, and birth date constitute “Personal Data” because that information can be used to directly or indirectly identify you. This information is collected and used according to the terms of our General Membership Agreement and as explained in this Privacy Policy. While you are using the Banner Bar™ ad-serving service software, we may automatically track certain information about your computer and your internet surfing behavior. This information includes:

• Your IP address;
• What browser you are using;
• What operating system you are using;
• Your connection speed;
• The speed of your computer’s processor;
• The amount of installed memory on your computer and the video monitor resolution at which you are currently using the Banner Bar service;
• The URL of the page you are visiting;
• The amount of time you have the Banner Bar service active, and whether you are actively surfing or not;
• Which of the Banner Bar optional services you select;
• Search terms entered into the search area on the Banner Bar;
• Programs running at the same time as the Banner Bar service that may interfere with normal Banner Bar operation and functionality.

You Can Close The Banner Bar™ Service At Any Time To Stop The Data Gathering Activities.

We collect no other user-entered data from other active programs on your computer. In addition, 10pays.com does not seek to record any credit card numbers, account numbers, passwords, or other personal data communicated in the course of transactions engaged while the Banner Bar™ is active. However, it is possible that in some instances, the operation of certain websites may result in such data being included in URL data, which can result in that data being captured in the course of normal operation of the Banner Bar™ service. Such instances are rare and are the result of poor security practices by those websites. In the unlikely instance that such information is captured, while it may be stored in our database, it will not be used or disclosed in any manner that is inconsistent with our Privacy Policy.

 

Other Data We May Request From Members:

If you earn enough funds such that we reasonably believe that a tax reporting obligation exists for us in your country, we may contact you to request additional information. For example, we may request the Social Security number of our U.S. members or similar taxpayer identifiers for non-U.S. members. If you are contacted and fail to provide the information that 10pays.com legitimately requires to comply with relevant law, the General Membership Agreement provides that payments to you may be withheld until that information is provided.

We may ask you for personal information at other times, including, but not limited to, when you enter a sweepstakes, contest or promotion sponsored by 10pays.com and/or when you report a problem with any of our services. Any data collected at those times will be used in accordance with this policy, unless otherwise explicitly stated at the time of collection. Many of those sweepstakes, contests, or promotions will have terms of service agreements associated with them and those agreements may differ from provisions of this policy. Therefore, it is important that you read and understand those agreements as the nature of those offerings may require different data privacy provisions that may supercede this Privacy Policy.

Message Boards:

If you utilize a message board operated by 10pays.com, your use of those services is governed by the Terms of Service agreement associated with those services. If you choose to publish your email address or publish other personal data, you do so at your own risk. If you have concerns regarding privacy issues related to the message boards, or wish to have a message removed from the message boards for privacy-related reasons, you should contact us.

About Cookies:

If you decide to join the 10pays.com membership community, at the time you submit your registration, and at any time you access your account information, 10pays servers place a “session cookie”. A cookies is a little piece of text stored by your browser on your computer, at the request of our server. Session cookies last until the conclusion of your visit to our website and allows our servers to correctly display pages based upon your account information. This is one way we provide you the ability to access your account statistics such as points and referrals accumulated.

The process we use to serve advertisements to the Banner Bar™ ad-serving window may involve the use of persistent cookies. These cookies remain stored over a longer period of time and help our ad serving vendors to make sure that you do not see the same ads repeatedly. Cookies received in this way may be monitored by 10pays and/or our ad serving provider. We have and maintain contractual arrangements that restrict our partners, including any ad-serving company, from using these cookies for anything other than fulfilling their service to you and 10pays.com.
We may also use cookies to deliver content specific to your interests, and to save your password so you don’t have to re-enter it each time you connect to the internet,

Sites Linked Via The Banner Bar™ Service:

Information about you may be collected by advertisers, merchants or other third parties when you click through advertisements on the Banner Bar™ service window or take advantage of offers linked via those advertisements. We have no control over the collection or handling of such data and urge you to review the privacy policies of those site before providing them with personal data. The Banner Bar™ itself also contains links to websites and 10pays.com is not responsible for the privacy practices or the content of such websites.

A Special Note About Children:

10pays.com wants to help parents protect the privacy of children. While 10pays.com does not consider our website and/or our Banner Bar™ service to be directed towards children under the age of 18, and does not knowingly accept members under age 18 (20 in Japan), we realize that some children may sign up as members providing incorrect information. As such, during the time they are involved in our community, certain information may be collected in the normal manner about their use of our services. To remove your child from the 10pays.com membership community, please contact us. To protect against the unintended removal of legitimate members, we may require certain information to verify the parent/child relationship.


Purpose Specification Principle:

Philosophy: 10pays.com adheres to the philosophy and principle that the purposes for which personal data are collected should be specified at or prior to the time of collection, and that any subsequent use should be limited to the fulfillment of the purposes not inconsistent with those purposes previously specified.

How we deliver: We clearly specify the purposes for which we collect personal information in this Policy and restrict our usage of that data to purposes reasonably related to those described. Prior to any new data usage that may be beyond the scope of previously disclosed purposes, we will disclose such new uses and obtain the data subject’s permission.

Visitors to Our Website:

We collect and process information about you in order to provide the services described in the General Membership Agreement. We will process your information to administer your membership, determine your eligibility for certain services, provide services to you (such as the Banner Bar), and enable you to take advantage of other member benefits. In addition to the purposes specified under the Collection Limitation portion of this agreement, we will use the personal information provided by members to verify your identity, to protect against fraud, and to send you updates about your account, including new products and services that may be specific to your membership and participation in 10pays.com, as well as company news updates, and notices regarding our policies and practices.

If you participate in the Banner Bar™ service, we may use the residence address information to send required tax notices and/or to contact you for reasons necessitated by a contact problem or other issue regarding your account. We use the URL information to create profiles that enable us to direct advertising to you that is more likely to be of interest to you or relevant to your surfing activities. We use your IP address to help diagnose technical problems and to administer our website and Banner Bar™ service.

The information we collect about your computer during the installation and use of the Banner Bar™ software is used in making sure that we send the appropriate automatic upgrades for the Banner Bar™ service software, as well as to more accurately plan the system requirements for future features and functionality.

If the Banner Bar™ service software detects an incompatible program, it may cease functioning altogether, or, in the case of software that is believed to be used to defraud 10pays.com, it may transmit that fact and any information to 10pays.com that we may use to identify you and your usage in order for us to determine whether fraudulent activity has or is taking place. No other information about the programs running on your computer is communicated by the Banner Bar™ service software to 10pays.com.

Use Limitation Principle:

10pays.com adheres to the philosophy and principle that personal data should not be disclosed, made available, or otherwise used for purposes other than those specified in accordance with the Purpose Specification Principle, except with the consent of the data subject (member) or as required by law.

How We Practice Our Philosophy:

10pays.com treats each member’s personal information as confidential and does not disclose it or use it except as stated in the General Membership Agreement and as further explained in this Privacy Policy. Specifically, 10pays.com will not disclose personally identifiable information about you to others unless:

• You give 10pays.com explicit and specific prior permission, or

• The disclosure is required by law or by a warrant authorized by a court of competent jurisdiction.

We do not give, sell, rent, share, or trade any identifiable personal information regarding our members with any third party, with the exception of third party contractors or service providers, such as our ad-serving partners and/or member payment processors and/or auditors, who work with the 10pays.com management group both domestically and internationally. All parties with whom we contract for such services are strictly prohibited by the terms of those contracts from any other use of the information.

It is 10pays.com’s policy to comply with reasonable warrants issued by courts to law enforcement officials. However, it is our policy to oppose attempts to seek release of member information by private parties through the use of civil subpoenas. When served with a civil subpoena, our policy is to notify the specified member of the request prior to disclosure of any personal data, and we may require the requesting party to seek court review of the appropriateness and sufficiency of the subpoena before we will disclose any of the requested member information.

10pays.com may share information regarding overall group demographics in aggregate or summary form with it’s customers, partners, potential and/or existing advertisers, or other third parties.

Individual Participation Principle:

10pays.com adheres to the philosophy and principle that our members have a right to know what type of information we maintain relating to them. Additionally, we believe all members should have access to any data we maintain on them at a reasonable cost, and the ability to challenge the accuracy of that data.

How We Practice Our Philosophy:

10pays.com provides it’s members with access to their account information via a secure (password protected) web interface. We allow our members to correct and update that information in a timely manner, following processes designed to insure the integrity of the information.

Personal data recorded about members, as described in the Collection Limitation Principle section, will provided to members upon their request, within a reasonable time period, and at a reasonable cost, according to the policies designed to assure the identity of the requesting party before this personal data is released. If upon receipt of the data, a member discovers errors in that data, we will correct them upon request. You may update, correct, access, or delete your personal data in accordance with the following procedures.

Accessing and Updating Your Personal Data Online and Offline:

You may update and correct your personal data by using the “Account Update” link found in our Members Zone area of our website. There is no cost for updating information contained on our website and all members are encouraged to maintain up-to-date information about their contact addresses and interests.

Subject to applicable law, any requests for information not contained on our website, may require the pre-payment of reasonable costs related to providing such information, due to the volume of data that may be involved and the costs of researching, preparing, processing and shipping such data. You may contact us with your request and we will provide you with further information about the costs and procedures (including identification verification) associated with retrieving and shipping that data to you.

Objecting to Processing of Your Personal Data:

You may object at any time to our processing of your personal data by contacting us and/or using the membership cancellation process found under the “Cancel Membership” link found in the Members Zone area located on our website. All requests made in manners other than using the cancellation process on the website will be subject to identification verification procedures to protect members account integrity.

Any member that elects to cancel their membership for whatever reason will be subject to forfeiture of referrals and accrued points and/or credits that have not met the payment threshold.

Retention of Your Personal Data:

You may quit the service at any time and all personal data relating to you will be taken out of active use for our advertising targeting processes. Our data retention policy requires that data pertaining to former members will be retained for a reasonable period of time necessary to fulfill our service obligations to members and to comply with applicable laws, and will then be deleted according to our normal practices.

How We Practice Our Philosophy:

As an ad-serving service, the information we collect from our members in the aggregate is the basis upon which we obtain value (advertiser revenue) on behalf of our members. Therefore, the nature of our business requires that we continuously collect statistical data about our membership as a whole. The relevance, accuracy, and currency of that information are all critical to serving the interests of our membership community by providing such information in a useful and actionable ways to the revenue producing advertisers in order to entice them to participate in our program. While it is important that all members do their part in keeping their information and interests current, it is only those pieces of information in group summary or aggregate form that advertisers or other third parties are allowed to view. Keeping your personal information confidential remains at the core of our Privacy Policy.

10pays.com has a general policy of openness about it’s practices and policies regarding personal data of members. 10pays.com states in detail what personal data it collects and why we collect it.
10pays.com also maintains a policy of disclosing any changes to our practices and policies. Any changes to our Privacy Policy or procedures that materially reduce the privacy protections encompassed therein, including any material changes in corporate ownership that impact upon the promises made in this Privacy Policy, will be disclosed with sufficient advance notice to allow those members affected to exercise informed choices regarding their personal information.

10pays.com is a U.S. corporation and all consumer data collected by 10pays.com is controlled from our headquarters, however the data may physically reside at numerous secure facilities around the globe according to the practices and policies detailed under the Security Safeguards section of this Privacy Policy. We may also transfer or share your personal information within the group of international service providers that are used to provide member services. We do this to improve the administration of services. All information collected as a result of your membership in 10pays.com will be controlled by either 10pays.com personally and/or through contractual relationships with our service providers who are required to adhere to our Privacy Policy. By becoming a member of 10pays.com, you give your consent to this transfer of your personal data.

An important note for all members: Please note that 10pays.com has centralized it’s control of records in the United States but may perform some of it’s data processing outside the United States.
